All providers with listing on this site are asked to pledge the following:
• We will not discriminate based on race, color, religion, sex, national origin, ancestry, disability, marital, family, pregnancy, sexual orientation, body size, gender identity, gender expression, veteran or citizenship status.
• We strive to make our language and marketing inclusive of the above.
• We agree to conduct our business in a way that upholds the best business practices of our profession.
• We will be upfront and fair about our prices and what services are provided.

PROVIDER AGREEMENT

Natural Resources All Families Foundation (“Natural Resources”) welcomes you to our Resources Directory website (“Directory”). We would like to set out our agreement (“Agreement”) for you to be able to market your services to potential clients on our Directory. Throughout this Agreement you will be known as the “Provider”. The service we provide will be referred to as “Service”,  potential clients who are looking for services will be referred to as “User” and the Resource Directory Website will be referred to as “Resource Directory”.

This Directory is a forum that facilitates communication between User and Provider for services related to pregnancy, birth & parentings. Natural Resources acts as a venue for providers and purchasers of pregnancy, birth & parenting services to exchange information with the goal of eventually forming a business relationship.

Each listing must being created for one official entity consisting of either an individual, or an cohort of closely affiliated providers. For example one listing should not include the websites and contact info for multiple providers. In instances where providers book and receive payment for their service independently they should have their own listing.    

Natural Resources does not guarantee that User will successfully find a Provider to his/her liking through this system. Likewise, Natural Resources does not involve itself in any agreement between User and Provider. We do not guarantee the completion of any agreement between User and Provider. User is solely responsible for assessing the integrity, honesty, experience, capability, and reliability of any Provider with whom User communicates through this Resource Directory. Similarly, Provider is solely responsible for assessing the integrity, honesty, and truthfulness of any User with whom Provider communicates through this Resource Directory. The use of this Resource Directory by a User does not imply an endorsement of any potential client. Natural Resources makes no representation regarding any User’s truthfulness, nor does it sanction any statement a User may post on the Resource Directory or communicate to the Provider. Natural Resources does not screen any potential User.

Provider understands and acknowledges that Natural Resources is not liable for any dispute, claim, controversy, or lawsuit that Provider and User may have against each other arising from the use of this Resource Directory and Service.

Provider may cancel it’s listing with Natural Resources at any time. Natural Resources reserves the right to terminate, cancel, block, and/or restrict Provider’s use of the Resource Directory and Service at any time with or without cause. However, examples of reasons why Natural Resources may terminate Provider’s listing include but is not limited to Provider’s attempt to circumvent paying fees to Natural Resources, complaint(s) from User about Provider, Provider failing to provide services to User after agreement has been made with User, and failing to abide by Natural Resources’ rules and policies.

Payments for all Listing Packages are nonrefundable and there are no refunds or credits for partially used periods or terminated accounts.

Provider agrees that Natural Resources is not responsible for any harm that this Service may cause. Provider unconditionally and absolutely agrees to indemnify and hold Natural Resources fully harmless from any and all liability arising from or in connection with the contents or use of the Service. Provider further agrees that the defense and indemnity shall include without limitation attorney’s fees and costs.

Natural Resources may change the Agreement at any time. Natural Resources further reserves the right to discontinue the Resource Directory without notice. Provider agrees that Natural Resources shall not be liable to Provider or any third party for any modification or discontinuance of the Service. Provider acknowledges and agrees that any termination of Service may be without prior notice, and agrees that Natural Resources may immediately delete data and files in the Provider’s account and bar any further access to the files.

Provider expressly agrees that the use of the Service is at Provider’s own risk. The Service is provided on an “as is” basis. Natural Resources expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. Natural Resources makes no warranty that the Service will meet Provider’s requirements, that the Service will be uninterrupted, timely, secure, or error-free. Furthermore, Natural Resources does not warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the program will be corrected. Natural Resources makes no warranty regarding any goods or services purchased or information obtained through the Service or any transaction entered through the Service. No advice or information, whether oral or written, obtained by Provider from Natural Resources shall create any warranty not expressly stated herein.

Natural Resources shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including but not limited to any damage caused by User in dealing with Provider. Furthermore, Provider agrees that Natural Resources shall not be liable for any damages arising from interruption, suspension, or termination of service, including, but not limited to, direct, indirect, incidental, special, or consequential damages, whether such interruption, suspension, or termination was justified or not, negligent or intentional.

Any claims or disputes arising out of this Agreement, including any claims for violation of the terms of the Agreement, shall be resolved under the laws of the State of California and shall be subject to arbitration. The arbitration shall be conducted in the San Francisco County, City of San Francisco, State of California, and any court having jurisdiction thereof may enter judgment on the arbitration award.

If any term or provision of this Agreement is held to be invalid, illegal or unenforceable, in any respect as written, the parties intend for any arbitrator construing this Agreement to modify or limit such provision so as to render it valid and enforceable to the fullest extent allowable by law. Any provision not susceptible of such reformation shall be valid and enforced to the fullest extent of the law. Furthermore, the provisions of this Agreement are severable, meaning that if any part is found to be unenforceable or inoperable, then such provision will be deemed severed, and all other parts will remain fully valid and enforceable.

USER  AGREEMENT

Natural Resources All Families Foundation (“Natural Resources”) welcomes you to our Resource Directory . We would like to set out our agreement (“Agreement”) for the use of our Resources Directory with you. Throughout this Agreement you will be known as the “User”. The service we provide will be referred to as “Service” and Provider that Users may be in touch with will be referred to as the “Provider”.

The Resource Directory is a forum that facilitates communication between Users and Providers (individuals, organizations and additional business entities) for services related to pregnancy, birth & parenting. Natural Resources acts as a venue for Providers and purchasers of pregnancy, birth & parenting services to exchange information with the goal of eventually forming a business relationship. 

Natural Resources does not guarantee that User will successfully find a Provider to his/her liking through this system. Likewise, Natural Resources does not involve itself in any agreement between User and Provider. We do not guarantee the completion of any agreement between User and Provider. User is solely responsible for assessing the integrity, honesty, experience, capability, and reliability of any Provider with whom User communicates through this Resource Directory.

The inclusion of any Provider on this Resource Directory does not imply an endorsement of any subscribing service Provider. Natural Resources makes no representation regarding any Provider’s qualifications, nor does it sanction any statement a Provider may post on the Resource Directory or communicate to the User. Natural Resources does not screen any potential Provider.

User understands and acknowledges that Natural Resources is not liable for any dispute, claim, controversy, or lawsuit that Provider and User may have against each other arising from the use of this Resource Directory and Service.

User understands and acknowledges that while there is no charge or fee to User for the use of this Service, Provider does pay a fee to Natural Resources in order to use this Service and solicit business from User.

User agrees that Natural Resources is not responsible for any harm that this Service may cause. User unconditionally and absolutely agrees to indemnify and hold Natural Resources fully harmless from any and all liability arising from or in connection with the contents or use of the Service.
